Andrew’s practice is focused on providing transactional, regulatory, and corporate services for construction industry clients. He represents construction project owners and developers, architects, engineers, project managers, construction managers, and contractors in connection with private and public construction projects.

Design and Construction Contracts

Sports Stadium/Arena Projects

  • Represented a Major League Baseball franchise in structuring and contracting with the design and construction teams for the development of a new stadium.
  • Represented project owners and developers of two Major League Soccer Stadiums.
  • Represented an architecture firm for a major addition to an existing MLS Stadium.

Energy & Cleantech Projects

  • Represent the owner in developing and negotiating contracts for the construction of two wind energy farms and the construction of switchyards to connect power generation facilities and electricity transmission grids.
  • Counseled the provider of sustainable geothermal heating and cooling systems on its construction contracts for residences in the Northeast.

Multifamily Development

  • Represent developers in structuring and contracting with the design and construction teams for the development of ground-up residential towers and conversion of office towers to residential towers.

Hotels/Hospitality Projects

  • Negotiate contracts for U.S.-based design firms with developers of hotel and hospitality projects in the Middle East.
  • Counsel design firm clients in connection with their contracts for the design of hotels with condominium units.

Industrial Projects

  • Counsel the owner of industrial sites in its development agreements with third-party fee developers.
  • Represent project owner in contracts with design-builders.

Corporate & Non-Profit Workplace Projects

  • Represent for-profit and not-for-profit companies in structuring and contracting with the design and construction teams for the development of corporate offices and office amenities.

National Retail

  • Represent fashion houses and other retailers to facilitate store expansion programs to additional locations.
  • Represent designers with their master agreements with national retailers.
Real Estate Access License Agreements
  • Prepare and negotiate access license agreements with neighboring property owners to facilitate construction of the project and protect adjacent property owners.
Design and Construction Defects; Contract Scope Issues and Project Delays
  • Counsel clients on contract rights and remedies when design and construction defects are discovered.
  • Counsel clients when scope of services/scope of work issues arise and corresponding contract modifications and change orders.
  • Counsel clients on contract duties, rights and remedies when there are project delays.
FF&E Licensing Agreements for Design Firms
  • Represent the designers of furniture, fixtures and furnishings in license agreements with national and specialty retailers.
  • Represent designers in their contracts with manufacturers of FF&E.
Professional Licensing
  • In connection with the practice of architecture, engineering and other design professions, counsel clients on state regulations and lawful practice.
  • For mergers and acquisitions, counsel purchasers on compliance of the surviving entity with state license requirements.
  • For firms expanding their practice to new jurisdictions, provide counsel regarding satisfaction of requirements in new jurisdictions.

Throughout Andrew’s career, he has worked in the New York office of national law firms.

Andrew is an affiliate member of the American Council of Engineering Companies of New York and a member of its Legal Counsel Group.
