Margherita is a general litigator who advocates for her clients across a wide range of high-stakes litigation matters, including ERISA and managed care disputes, IP infringement, and bankruptcy and restructuring matters.

Margherita assists her clients navigate a variety of high-stakes litigation matters across multiple disciplines and before many different courts and tribunals.  Margherita has experience practicing before numerous state courts, federal courts, appellate level courts, and the International Trade Commission, and through all phases of a dispute—from the initial analysis, informal and often alternative-dispute resolution, and the preparation and filing of a lawsuit, through discovery and trial.  

Margherita frequently represents health care providers in ERISA and managed care litigation. Margherita’s health care provider clients value her experience and knowledge of a relatively niche industry, as well as her facility with health care consultants, actuaries, network experts, and other expert witnesses to aid in proving her client’s case.

Margherita also has experience representing clients in the IP space, having litigated trademark infringement and Lanham Act cases as well as patent infringement matters, including Section 337 Violation Investigations before the Internal Trade Commission.   

Prior to joining AFS, Margherita cut her teeth in one of the premiere bankruptcy and restructuring litigation practices in the country, having represented both debtor-side and creditor-side clients in some of the most high-stakes, consequential bankruptcies of the last several years.

  • Represented dialysis provider in high-dollar value network dispute in Hawaii State Court against national brands including MultiPlan, Inc. Principal drafter of a successful dispositive motion that led to a favorable settlement of the matter.
  • Represented cutting-edge technology company in a Section 337 Violation Investigation before the International Trade Commission, including through the investigative hearing.
  • Represented fashion company in Section 337 Violation Investigation concerning certain design patents before the International Trade Commission.
  • Represented dialysis provider in tortious interference dispute against health care consulting company in Florida State Court.
  • Represented generic pharmaceutical manufacturer against branded pharmaceutical manufacturer in commercial contract dispute relating to infringement of a patent.
  • Represented well-known fashion brands in trademark enforcement litigation, including in Lanham Act cases.
  • Represented high-worth individual in a cutting-edge adversary proceeding brought by the liquidating trust of a large cryptocurrency company.
  • Represented unsecured creditors committees in numerous high-profile bankruptcies including PG&E, Intelsat, and PHI.
  • Represented equity sponsor in both a high-profile retail bankruptcy and in related tortious interference litigation in New York State Court.
