Jenkins Quoted on Commerce Department Plan to Raise Patent Fees

Partner Marylee Jenkins, former US Patent and Trademark Office Patent Public Advisory Committee (PPAC) chairperson, was quoted by The Wall Street Journal on the discussion from the US Department of Commerce on charging patent holders 1% to 5% of their overall patent value.
The new fee is being considered by US Commerce Secretary Howard Lutnick as part of his plan to raise revenue and narrow the federal budget deficit. The plan is likely to face domestic pushback from businesses, as well as international backlash.
Marylee said, “I’m not seeing how charging a percentage of what the US government thinks the valuation of your IP is encourages innovation.”
