Showalter Quoted as Litigators Question President Trump’s Demands

Partner J. Michael Showalter was quoted on President Donald Trump’s new policy invoking Rule65(c) of the Federal Rules of Civil Procedure as a litigation-deterrence strategy.

President Trump’s new policy requires plaintiffs to post security bonds for injunctions against government policies. Mike highlighted that the rule serves as a strategic talking point for the Administration, potentially deterring legal challenges.

“He’s a maximalist person, and he has people [in his administration] that have big theoretical issues with how the government was structured — coming from a bunch of different directions,” Mike said.

He noted, “The whole point of the American constitutional system is things are supposed to move pretty slowly because nobody has to trust each other,” adding that the Trump Administration is “aggressively working to change the established political order.”
