In 2025, institution rates dipped sharply mid year—falling to roughly 51% in Q2 2025 from about 67% in Q1 and 75% in the same quarter of 2024—intensifying the premium on front end petition quality and forum coordination. And as discretionary denials increased, parties adjusted their mix of options, with ex parte reexamination rising to more than a quarter of post grant filings while the share of inter partes review declined.
